Terms and Conditions — StartenMetTrading.nl

1. Definitions

  • StartenMetTrading.nl ("we", "us"): the operator or the website startenmettraden.nl and provider or the products and services described below.
  • Customer ("you", "your"): the individual or legal entity that creates an account or purchases a product.
  • Token: a one-time digital license that grants you the right to generate a trading bot via the Trading Bot Builder.
  • Bot Builder: the online tool that automatically generates trading bot source code based on your strategy configuration and a valid token.
  • Free tools: the Trading Strategy Maker, Trading Plan Maker, and other freely available tools on the website.

2. Applicability

These terms apply to all use or the website, account creation, and the purchase and use or products and services from StartenMetTrading.nl. By using our website or services, you agree to these terms.

3. Account

You're responsible for keeping your login credentials confidential. All activities under your account are your responsibility. We reserve the right to block accounts if we suspect misuse.

4. Products and Services

4.1 Free Tools

The Trading Strategy Maker, Trading Plan Maker, and other free tools can be used without an account or payment. Strategies and plans you save are linked to your account when you're logged in.

4.2 Bot Builder Tokens

A token gives you the right to generate trading bot source code once for one platform (MT4, MT5, or Pine Script), or for all three platforms with a bundle token. Each token also includes two revisions that let you request adjustments to the generated code.

4.3 Token Usage

  • A token is personal and non-transferable.
  • A token is single-use. Once you've generated a bot, the token is consumed.
  • Tokens don't expire unless otherwise stated at purchase.
  • You can't reuse a consumed token.

5. Pricing and Payment

All prices are in euros and include VAT unless stated otherwise. Payment is made through the available payment methods during checkout. The agreement takes effect when your payment is confirmed and you receive the token.

6. Right or Withdrawal and Refunds

6.1 Digital Products

Our products are digital products made available immediately after purchase. In accordance with Article 6:230p sub c or the Dutch Civil Code, you waive your right or withdrawal when purchasing, because delivery or digital content begins immediately after confirmation or your purchase.

6.2 Unused Tokens

If you've purchased a token but haven't used it yet (the token hasn't been consumed), you can contact us at info@startenmettraden.nl within 14 days or purchase for a refund. We'll refund the full purchase amount after verifying that the token is unused.

6.3 Used Tokens

Refunds aren't possible for consumed tokens. A token is considered consumed as soon as a bot has been generated with it.

6.4 Technical Issues

If the Bot Builder is unable to generate a bot due to a technical problem on our end, we'll orfer you either a replacement token or a full refund—your choice.

7. Intellectual Property

7.1 Generated Code

The source code generated by the Bot Builder is for your personal use. You may freely use, modify, and deploy the code on your own trading accounts. You may not resell the generated code or orfer it as a service to third parties.

7.2 Website Content

All other content on the website (texts, images, designs, tools) is owned by StartenMetTrading.nl and may not be reproduced or distributed without written permission.

8. Liability

8.1 Not Investment Advice

StartenMetTrading.nl provides educational tools and information. Nothing on this website constitutes investment advice. We are not a financial advisor and are not supervised by the AFM or DNB.

8.2 Trading Risk

Trading financial instruments carries significant risks. You can lose part or all or your capital. The code generated by the Bot Builder is a tool and not a guarantee or prorit.

8.3 Limitation or Liability

We are not liable for direct or indirect damages resulting from the use or our website, tools, or generated bot code, including but not limited to trading losses, lost prorits, or data loss. The generated bot code is provided "as is" without any warranty or correctness or suitability.

8.4 Maximum Liability

If we are held liable despite the above, our liability is limited to the amount you paid for the relevant product.

9. Availability

We aim for high availability or the website and tools, but we don't guarantee uninterrupted or error-free operation. We reserve the right to temporarily take the website or specific tools orfline for maintenance or updates.

10. Changes

We may modify these terms. The current version is always available on this page. We'll inform you or substantial changes via email or the website. Continued use after changes indicates acceptance.

11. Applicable Law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in 's-Hertogenbosch.
